INTRODUCTION TO DELIVERGATE

Delivergate Ltd (Delivergate) is a company founded in July 2020, with its primary place of business located in Unit 11 West Point 328 Bath Road Hounslow TW4 7HW, United Kingdom. Delivergate’s key product is a software application (Service) that helps eateries, bistros, restaurants, cafes, pubs, cloud kitchens and enterprises (Clients) in managing their delivery and takeaway platforms.

INFORMATION WE COLLECT

We collect information from and about Users of our Service

• Directly from you when you provide it to us.
• Automatically when you use the Service.

The Information Provided by You

We collect personal information that you voluntarily provide to us when you express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services,  when you register for a Delivergate account or when you contact us. We collect this information to enable the provision and improve the quality of our services.

• We remember your full name, your business name your business addresses, your business phone number (optional), your email address, Social Profile URL, the content you’ve published on the Supported Platforms you’ve connected to the Delivergate and Information we may receive relating to communications you send us (queries or feedback).
  All personal information that you provide to us must be true, complete and accurate, and you must notify us of any changes to such personal information.
• When you contact “Support” you might provide additional information necessary for us to provide support services, including testing and diagnostics, and quality control processes around your use of Delivergate Services.
• Subscribers may provide business-related information to us regarding revenue, sales, discounts, staff and personnel information, menu management and related data pursuant to the financial reporting features of Delivergate.

Once a Delivergate client connects a third-party delivery platform to the Service, they will be able to access, collect, process and share data from the selected delivery provider (subject to the terms of service and privacy policies of the Supported Platforms).

This includes orders, notes, posts, comments, profiles, images, feeds exchanged on the Supported Platforms, user communications and user IDs of Support Platforms etc.

Automatic Information Collection and Tracking.

When you use the Delivergate or Visit the site, it may use technology to automatically remember the following information.

• Actions you execute on the Site and on the Supported Platforms
• The type of hardware and software you are using
• Information obtained from cookies such as IP address, browser and device type, access times, the web page from which you came, the regions from which you navigate the web page, and the web page(s) you visited

HOW WE USE YOUR INFORMATION

We use information that we collect about you or that you provide to us, including any personal information, to:

• Provide you with the Services you request from us, including, for example, to facilitate payments, send receipts, authenticate Users and send product updates and administrative messages.
• Send or facilitate communications between you and independent third-party food and delivery service providers to enable them to provide such services, such as food orders, special requests or preferences, payment and delivery details (including device location and delivery address).
• Perform internal operations, including, for example, to prevent fraud and abuse of our Services; to troubleshoot software bugs and operational problems; to conduct data analysis, testing, and research; and to monitor and analyze usage and activity trends.
• Send you communications we think will be of interest to you, including information about products, services, promotions, news, events of the Company and other companies, where permissible
• Personalize and improve the Services, including to provide or recommend features, contents, social connections, referrals and advertisement.
• Fulfill any other purpose for which you provide it.
• Give you notices about your account/subscription, including expiration and renewal notices.
• Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
• Notify you when software updates are available, and of changes to any products or services we offer or provide though it.
• To ensure the safety and security of the Service.

COOKIES AND OTHER SIMILAR TECHNOLOGIES

When you interact with our online services, or open emails we send you, we obtain certain information using automated technologies, such as cookies, web server logs, web beacons and other technologies. A “cookie” is a text file that websites send to a visitor’s computer or other internet-connected device to uniquely identify the visitor’s browser or to store information or settings in the browser.

We use these automated technologies to collect your device information, internet activity information, and inferences as described above. These technologies help us to:

• Remember your information so you do not have to re- enter it. This allows us to identify the number of unique visitors we receive, so that we can provide enough capacity to accommodate all of our users;
• Track and understand how you use and interact with our online services and emails (e.g. when you use certain features or upload attachments);
• Tailor and customize elements of the promotional layout and content of our online services to your preferences;
• Measure how useful and effective our services and communications (including advertising campaigns) are to you with the goal of improving these services and communications;
• Allow our business partners (including third parties) to use these tracking technologies to track your behavior on our behalf on our Services (including when you use multiple devices) and on our partner websites
• Enable third parties to track how you interact across sites outside of our Services; and
• Collect anonymous statistical information about how you use the Services (including the length of your web or application session) and the location from which you access the Services, so that we can improve the Services and learn which elements and functions of the Services are most popular with our users.

Your browser can alert you when cookies are placed on your device, and how you can stop or disable them via your browser settings.

Essential Cookies

Essential cookies are cookies that enable you to navigate and use all the features in the Services provided by us. For example, without these, you would not be able to navigate between pages on the website.

Functionality Cookies

These cookies enable us to remember you have used our Services before, preferences you may have indicated and information you have provided to us to give you a customized experience.

Performance and Analytical Cookies

This information is used to make sure our Services can cope with the volume of users, to help us correct errors in the Services and to measure use across our Services.

Retargeting or Advertising Cookies

We use third parties, for example, Google Analytics, to analyze statistical information from users of the Site. We might be able to associate such information with other information which we collect from you once we receive it from a third party.

we use cookies to better understand your needs as a User, to analyze trends, to recommend more relevant content or services, and to improve the features and general usability of the Site and Services.

MINORS

We do not knowingly gather personal information from persons under the age of 18. If we learn that we have collected the personal information of an individual under 18 we will take steps to delete the information as soon as possible. Our marketing, sales, and Services are not directed at people under the age of 18.

SECURITY OF YOUR INFORMATION

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration and disclosure. All information you provide to us is stored on our secure servers behind firewalls.

We use industry best practices to keep any information collected and/or transmitted to the Supported Platforms secure. The website and Service are all secured by SSL protocol, which provides encryption to all data transmitted.

Information stored within Delivergate’s servers is restricted to a limited number of key employees.

When payments to us are processed via credit card, we use a third-party vendor that is PCI_DSS compliant.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our App, you are responsible for keeping this password confidential. We ask you not to share your passwords with anyone.

Delivergate reviews its information collection and processing practices periodically and will review and alter this Privacy Policy accordingly.

RETENTION OF PERSONAL INFORMATION

We will retain your personal information for the period necessary to fulfill the purposes outlined in this Privacy Notice unless a longer retention period is required or permitted by law or our document retention policies and procedures.

If you correspond with us by email, post service, or via any other form of communication, we may retain the correspondence and information contained in it and use it to respond to your inquiry; to notify you of updates or Services that may be relevant to you; or to keep a record of your complaint/request. If you would like us to remove you from our contact list or exercise your rights related to your personal information, please contact us at hello@delivergate.com. We will respond to your request within 30 days.

THIRD PARTIES

You should be aware that Delivergate acts as a connection between our Clients and third-party supported platforms. In certain situations, the content published via Delivergate will not be in Delivergate’s control. Hence content you share through supported platforms via our Services may continue to be available to third parties and the public at large, as this content is now under the control of the operators of the supported platforms.

DATA RIGHTS AND ACCESS TO PERSONAL INFORMATION

You have rights under applicable data protection laws. These may include the right;

• To request access and obtain a copy of your personal information
• To request rectification or erasure
• To restrict the processing of your personal information;
• In certain circumstances, you may also have the right to object to the processing of your personal information.

We will consider and act upon any request in accordance with applicable data protection laws.

If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time. Please note however that this will not affect the lawfulness of the processing before its withdrawal, nor will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent. When you withdraw consent, you acknowledge and accept that this will terminate your access to the use of our Service. To be certain, please request alteration or removal of your information at any time by sending an email containing your request to hello@delivergate.com. We will respond to your request within 30 days.

Please note that some personal information may need to be retained by Delivergate for a period of time following cancellation of your account where this is necessary for our legitimate business purposes or required or authorized by applicable law.

Delivergate does not rent or sell your information. but we may disclose such data to a limited group of trusted third parties in the circumstances clarified below. By using our Service, hereby explicitly agree to the following.

• We reserve the right to disclose your personal information where we are bound to do so, at law or via a court order as well as to meet any legal or regulatory requirement or obligations.
• We reserve the right to reveal your information to any third party if we have sufficient information to believe that the disclosure is necessary for an investigation and/or for the enforcement of any breaches of the Terms of Service (if applicable), to detect, avert or otherwise address fraud, security, technical issues or other indiscretions or illegalities, protect the rights and interests as well as the property of Delivergate.
• We reserve the right to disclose your information if we are acquired by or merged with another entity (in which case we will require such entity to assume our obligations under this Privacy Policy or inform you that you are covered by a new privacy policy)
• We reserve the right to disclose your information to parent companies, joint ventures, subsidiaries, or other companies under common control with Delivergate.

CHANGES TO OUR PRIVACY POLICY

We may update our privacy policy from time to time. If we make material changes to how we treat our Users’ personal information, we will post the new privacy policy on this page with an in-App alert the first time you use the App after we make the change.

The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable e-mail address or phone number for you and for periodically visiting this privacy policy to check for any changes.

CONSENT

By using the Service, or submitting personal information to the Service, or collecting personal information from Supported Platforms via the Service, you consent to the collection, processing, transfer, storage disclosure, and use of your personal information in the method set out in this Privacy Policy. If you do not wish for your personal information to be used in these ways, you shall discontinue using the Service.

DEFINITIONS

Delivergate’s Privacy Policy forms part of its wider Terms of Service. Both the Terms of Service and the Privacy Policy apply to your use of the Service.

• “EU Data Protection Law” means European Union Regulation 2016/679 (“GDPR”).
• “Personal Data” has the interpretation given to them in the GDPR.
• “End-User(s) or User” means a user of a supported platform who interacts with a Delivergate Customer through that supported platform.
• “Service” refers to the services provided to you by Delivergate based on the plan you have acquired.
• “Supported Platform(s)” means the delivery channels currently supported by the Service, including Uber Eats, Deliveroo, Just Eat, and other delivery channels as described on the Site;
• All capitalized terms that are not otherwise defined herein shall have the meaning given to them in our Terms of Service which can be found at https://delivergate.com/terms-and-conditions/.
